The following terms and conditions govern all use of the EduBit website and all content, services and products available through the website, including, but not limited to, the user area (collectively referred to as the “Site”).
Please read these Terms and Conditions carefully before completing any registration or payment for an EduBit. By accessing and using the Service you agree to be bound by these Terms. These Terms apply to all visitors, users and others who access or use the Service.
EduBits is an assessment platform through which clients are able to be assessed under the specifications of the EduBit to which they sign up. Clients are not deemed to be officially enrolled students and are not eligible for any type of student loan, scholarship, or allowance.
The Operator reserves the right, in its sole discretion, to change, modify, or discontinue any aspect or feature of this Site in whole or in part, including, without limitation, the content, availability, access and/or the Terms of the Site. Such changes, modifications, additions or deletions will be effective immediately upon notice thereof, which notice may be made by posting such changes on this Site.
The Operator makes no warranty, either expressed or implied, of the accuracy, merchantability, fitness for a particular purpose, or non-infringement of the information provided by third parties. This includes, but is not limited to, any information found on a link located on this site that allows users to access information found on another site. Additionally, the Operator does not warrant the existence or functionality of any website which can be accessed through a link located on this site.

The Client is responsible for maintaining the security of his/her user area account, and are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must immediately notify the Operator of any unauthorized uses of your account or any other breaches of security. The Operator will not be liable for your acts or omissions, including any damages of any kind incurred as a result of such acts or omissions.
The Clients use of this site is at their sole risk. They are responsible for taking precautions as necessary to protect themselves and their computer systems from viruses, worms, trojan horses, and other harmful or destructive content. The Operator is not responsible for any damages or disruption caused by uploading any assessment from the EduBits website.
Personal Identification Information
The Operator may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit the site, register on the site, fill out a form, respond to a survey, and in connection with other activities, services, features or resources the Operator makes available on the Site. Users may be asked for, as appropriate, name, email address and phone number. The Operator will collect personal identification information from Users only if they voluntarily submit such information to the Operator. Users may choose not to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.
The Operator will adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.
The Operator will have the right to view information stored in your account to meet the purposes of the Site and the Operators responsibilities to Users.
The Operator will not sell, trade, or rent your personal identification information to others. The Operator may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with its business partners, trusted affiliates and advertisers for the purposes outlined above. The Operator may use third party service providers to help it operate its business and the Site or administer activities on its behalf, such as sending out newsletters or surveys. The Operator may share your information with these third parties for those limited purposes provided that you have given the Operator your permission.
If an employer, industry body or other organisation has paid some or all of the EduBit assessment costs or has endorsed an EduBit, we reserve the right to share with them information about which of their employees/members have registered, submitted and achieved assessments.
In signing these Terms and Conditions, the Client is confirming their identification is correct and real. When submitting an assessment, you (the Client) agree that the material you submit is substantially your own work and that you have the appropriate permission to use material that is not your own and that you have acknowledged the sources of that material.
Using assessment developed in your workplace
If the assessment you (the Client) complete is created at your workplace, you need to ensure that you have the permission of your employer to be able to use the work in question.
EduBits may recommend learning or information that will assist the Client to build their knowledge and skills relevant to the assessment. These recommendations do not guarantee that every aspect of the assessment is covered by the recommended learning or that by undertaking these courses/accessing this information that the Client will pass the assessment.
An EduBit or several EduBits are in no way a guarantee of credit towards a qualification or entry into any academic institution, including Otago Polytechnic. An academic institution may take into account EduBit assessments and choose to offer credit towards a qualification or admit a student into a specific course but this is at the sole discretion of the specific institution.
If an assessment is not achieved, the Client may appeal the decision. Please refer to the Otago Polytechnic Academic Appeal Process for Learners policy at the following website;
Refund of the EduBit fee may be applied in some extenuating situations.
The Operator or its third party content providers shall retain all worldwide rights in the intellectual property in and on the Site, including, but not limited to, trademarks, service marks, trade dress, inventions, ideas, trade secrets, the source code, the HTML code, the "look and feel" of the Site, its colour combinations, layout, and all other graphical elements, and the copyrights in and to its original content. You should assume that everything you read or see on the Site is copyrighted, trademarked, or otherwise protected and owned or licensed by the Operator.
EduBits reserves the right to update the above Terms and Conditions at any time. The newest version of the Terms and Conditions are considered to be those that have been accepted by the Client.
